Judge Richard Posner of the Seventh Circuit of the United States Court of Appeals said to the Daily Beast, The Supreme Court is not a real court but a Quasi-Political Body “It’s very political. And they decide which cases to hear, which doesn’t strike me as something judges should do. You should take what comes. When you decide which case to hear it means you’ve decided the cases ahead of time.” This anti-gun ruling from the 8th Circuit is contrary to most federal courts of appeals which in fact protect the 2d Amendment Rights of law-abiding Americans to own guns. Which is why when Missouri Attorney General Chris Koster refused to file an Amicus Brief in support of law abiding Missouri gun owners he undermined our gun rights.
On Monday, October 5, 2015 (Washington, D.C.) the first day of its new 2015-16 term, the U.S. Supreme Court denied any review in the case of (former Dean of Students for Columbia College) Dr. Allan Rodgers, et al., v. Daniel Knight # 15-116, a First Amendment retaliation and gun rights case. The Court receives over 11,000 requests for hearing a year and hears fewer than 70 cases each year. Congress in 1988 granted the High Court discretion as what cases it would hear, permitting dysfunction in the federal courts.
Stephen Wyse, plaintiffs’ attorney, stated that he was disappointed that the Supreme Court refused to hear this case. As a citizen of the Missouri and the Eighth Circuit of the U.S. Court of Appeals, he noted the legal protections enjoyed by most Americans are denied to the citizens in the seven states of the Eighth Circuit. This reinforces our status of being “Lesser Americans” in the eyes of the law.
Wyse’s sharpest criticism targeted Missouri Attorney General Chris Koster. “Attorney General Koster abandoned law-abiding gun owners in Missouri and refused to file an Amicus Brief with the High Court. When Missouri law that grants our citizens the right to have a concealed firearm on their property is declared void as applied by the federal courts, it affects every Missourian. The precedent this case establishes that our citizens can be arrested and prosecuted, even though Missouri law legally entitles them to have a firearm even when they have a concealed carry permit.” Wyse said.
These illegal seizures of these fathers’ guns by the police were done in retaliation for Plaintiff Gregory Rodgers filing a misconduct complaint against police (admitted “catalyst”) and Plaintiff Robert Franklin denying consent to search his home. Franklin’s son was later prosecuted for possessing his father’s gun by mail being nearby while the son was in North Carolina. The Constitutional Rights of these fathers and sons are protected under the law outside of Missouri and the Eighth Circuit.
