Medical Malpractice

Car Accidents are usually complicated events. An early investigation by an experienced attorney and investigator is critical for successfully recovering damages. Evidence must be documented and preserved. Statements from witnesses must be taken. Whether your vehicle accident involves a rear-end collision, a side-swipe, a head-on, or other accident scenario, we have likely seen it before. Our experience and proven results can work for you.

Even low impact collisions can result in injury, including painful and debilitating muscle injuries to your neck and back (often referred to as whiplash). More severe collisions can result in injuries to the spine, back and neck that can cause paralysis. We have represented clients with all types of injuries and we know how receive full compensation for you.

Statistically, Americans are more likely to be injured in an automobile accident than any other type of accident. It is important that after suffering from an injury, you hire experienced and aggressive representation to protect your legal rights. After a serious accident you may have many questions like:

1. Who will pay my medical bills?

2. Who will pay my lost wages?

3. What if I need medical treatment in the future?

4. What if the person who hit me doesn’t have insurance?

The answer to these questions often must be answered by a review and analysis of several different insurance policies such as your auto insurance policy, the insurance policy of the driver at fault, your health insurance policy, your homeowner’s insurance policy, and any disability policy you may have.

Insurance companies do NOT work for your interests; it is their job to pay you as little as possible to settle your claim. In fact, your insurance company may even discourage you from hiring an attorney. At Wyse Law Firm, we fight for your case and make sure you receive the benefits and justice you need after a personal injury.

When the actions of doctors and nurses fall below the standard of care for their specialty, there is a chance they have committed medical malpractice. Representing clients injured by the malpractice of a health care provider can be complicated and expensive to pursue. Medical malpractice cases require a law firm that fully understands the law, the complex medical issues involved, and the standard of care which the provider may have violated. Medical professionals make mistakes. If they do, and serious injuries are the result, they should be held responsible just like everyone else. Patients are owed no less.

Medical malpractice can occur in doctor’s offices, hospitals or nursing homes. It may involve failure to diagnose, botched surgeries, failure to properly treat or prescribe medication, or birth injuries. Regardless of your situation, if you or a loved one has suffered a serious, permanent injury or death, we will give you a free consultation to discuss your potential case.

Doctors can be found negligent if they fail to care for a patient as a reasonable physician would under the circumstances. Medical negligence cases are complex, and require testimony from an expert witness to establish what went wrong, and the impact in damages on the injured person. It takes an experienced attorney to navigate a complex medical case. We have that experience and the contacts to reach out to other experts when need for your case.

A. Get your injuries treated

If you have injuries at the scene, do not drive yourself away. Have yourself fully evaluated and treated by a medical professional.

B. Document your injuries

It will be much easier to prove the injuries you suffered if you have photos. Photograph injuries and document everything you are forced to endure as a result of the injuries.

C. Do not give a statement

The other side’s insurance company is going to try to get you to give a statement – either through an investigator or adjuster. Limit your statements to the police officers.

D. Do not sign anything

The insurance company will try to convince you to sign a medical authorization or other document so they can collect your medical records. The law protects you from unlimited medical record searches. Know your rights before you sign anything.

E. Preserve the evidence

If your case involves a car or truck, take photographs of the damage. If your case involves a defective product, preserve the product in the same condition. Keep in mind that if you own it, you are entitled to keep it.

F. Do not rely on an insurance company

Whether it is the insurance adjuster or your own agent, you have to do your own investigation to determine whether there is additional coverage. Injured persons are seldom told about medical payments coverage, underinsured coverage, or other potential recoveries. You should talk with an attorney who is on your side before settling your claim.

G. Do not settle your case early

Insurance companies will try to get you to settle early. Always remember they are not on your side. You only get one chance to resolve your claim, and you must make it count.
